Terms of service

These Terms of Service ("Terms") govern the purchase of paid or free-entry tickets to cash‑prize draws (each a "Draw") promoted by Win With Trust ("we", "us", "our"), a company in England and Wales with its registered office Win With Trust 5 South Charlotte Street, Edinburgh, EH2 4AN.

By buying, receiving or holding a Draw ticket (a "Ticket") you confirm that you have read and agree to be bound by these Terms, our Returns & Refunds Policy, Prize‑Draw Rules, Privacy Policy and Cookies Policy (together the "Agreement"). If you do not agree, please do not purchase or submit any entry.


1. Eligibility

  1. You must be 18 years of age or older, a resident of the United Kingdom, and legally capable of forming a binding contract. We may require documentary proof of age and residency before accepting or validating any entry.
  2. Employees, contractors and immediate family members of Win With Trust, its draw auditor or any agency directly involved in a specific Draw are not eligible for that Draw.

2. Classification of our service

  1. Each Draw is intended to be a prize competition with a free postal entry route (see Clause 4 below) and therefore not regulated as a lottery under the Gambling Act 2005. We reserve the right to modify entry mechanics to ensure continued compliance.
  2. If at any time a Draw is determined by a competent authority to be a licensable lottery, we may suspend or void that Draw, refund paid entries in full and comply with any directions issued by the UK Gambling Commission.

3. Ticket pricing & limits

  1. The maximum number of paid Tickets available equals the advertised Prize Fund (e.g. a £1,000 Prize Fund = 1,000 paid Tickets).
  2. Paid Ticket limit: up to 50 paid Tickets per natural person per Draw. Orders that exceed the limit may be partially fulfilled or voided at our discretion.
  3. Ticket prices are inclusive of VAT (where applicable) and quoted in Pounds Sterling (GBP). Payment must be made using one of the methods offered at checkout.

4. Free postal entry route

  1. A single free entry is available per natural person for every Draw by sending a correctly completed postal entry to the address set out in the Draw Rules.
  2. Postal entries must be received (not merely posted) by the time and date advertised for the Draw to close. Late, illegible or incomplete entries are invalid.

5. Formation of contract

  1. For paid entries, a binding contract is formed when we email you a confirmation of purchase. If payment is rejected, no contract is formed and your entry is void.
  2. For free postal entries, a contract is formed when we receive and validate your postal entry and send a confirmation email.

6. Draw process & determination of winners

  1. The Draw will take place on the date and at the time advertised on the corresponding Draw page. We may livestream the Draw or publish a verifiable random‑number‑generation log.
  2. The winning Ticket will be selected at random using an independently verified process.
  3. We will notify the winner(s) by email and/or telephone within 48 hours of the Draw.
  4. The winner(s) may be required to provide proof of identity, age and UK residency within 14 days to claim the Prize Fund.
  5. If a winner cannot be contacted, fails eligibility verification, or fails to claim the prize within the stated time, we may withdraw the prize and select an alternative winner, or deal with the prize as directed by an independent adjudicator.

7. Prize Fund

  1. The advertised Prize Fund is the maximum total pool that will be distributed to winners if all available paid Tickets are sold.
  2. The Prize Fund is allocated between the top three places as follows:
    1. 1st Place: 50 % of the final Prize Fund
    2. 2nd Place: 30 % of the final Prize Fund
    3. 3rd Place: 20 % of the final Prize Fund. These percentages apply whether or not the maximum number of Tickets is sold.
  3. If fewer than the maximum Tickets are sold, the Prize Fund will be reduced pro‑rata to reflect the total paid entry fees actually received, and the same 50 % / 30 % / 20 % split will be applied to that reduced fund.
  4. No alternative cash or non‑cash prizes are offered unless explicitly stated.

8. Refunds & cancellations

  1. All Ticket sales are final and non‑refundable except in the limited circumstances set out in our Returns & Refunds Policy (duplicate charge or full cancellation of a Draw).
  2. We reserve the right to cancel, suspend or void a Draw for reasons including, but not limited to, fraud, technical failure, force majeure or regulatory intervention. Our liability in such circumstances is limited to refunding the paid entry fees for that Draw.

9. Fraud & disqualification

  1. We may disqualify, suspend or void any entry (paid or free) if we reasonably suspect: (a) breach of these Terms; (b) fraudulent, automated or bulk entry; (c) circumvention of the 50‑ticket limit; or (d) any act which, in our sole opinion, compromises the fairness or integrity of the Draw.
  2. Disqualified entrants forfeit all fees paid and have no claim against us.

10. Intellectual property

All website content, logos, trademarks, text and graphics are owned by or licensed to Win With Trust. You may view and print site pages for personal use only. No other use is permitted without our prior written consent.

11. Liability

  1. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under UK law.
  2. Subject to Clause 11.1, we shall not be liable for any loss of profits, business interruption, loss of data, or any indirect or consequential loss arising out of your participation in a Draw or use of our website.
  3. Our maximum aggregate liability to any entrant shall not exceed the price paid for their Ticket(s) for the relevant Draw.

12. Data protection

We process your personal data in accordance with our Privacy Policy and UK data‑protection laws. Age and identity verification checks may involve sharing data with third‑party identity‑verification providers.

13. Complaints & alternative dispute resolution

If you have a complaint, please contact Hello@winwithtrust.co.uk. If we cannot resolve your complaint within 8 weeks, you may refer it to RetailADR (www.retailadr.org.uk), an independent UK alternative dispute‑resolution provider. Their decision is not binding on either party unless you accept it.

14. Governing law & jurisdiction

These Terms and any non‑contractual obligations arising out of them are governed by English law. You and we submit to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates when the latest changes were made. Changes will not apply retrospectively to Tickets already purchased; you should check these Terms each time you enter a Draw.
